Privacy Statement

The protection of your data is important to us. It is therefore a key concern of ours to handle your data with care and to ensure a high degree of data security.

The companies of the EMS Group ("EMS") are dedicated to handling your personal data responsibly. EMS therefore intends to comply with all legal requirements in Switzerland (Swiss Data Protection Act, DPA; Swiss Data Protection Ordinance, DPO; Telecommunications Act, TCA; and other provisions of Swiss data protection law) as well as, with respect to personal data of users from the EU area, the corresponding requirements in the EU area (provisions of the EU General Data Protection Regulation, GDPR).

This Privacy Statement applies to personal data that EMS receives from natural persons through various sources (websites, mobile apps, social media, applicants, customers, suppliers and other business partners).

1. Purposes of the collection, processing and use of personal data

Personal data are "data/information that are associated with identified or identifiable natural persons". Online identification characteristics such as IP addresses count as personal data unless they are specifically anonymized.

We process your personal data for the following purposes:

  • subscribing to newsletters
  • completing contact forms
  • optimising the website (adapting the website to your needs)
  • defending against and recording hacking attacks
  • creating usage statistics
  • marketing
  • online applications
  • initiating and transacting business

2. Visiting the website

2.1 Log files

When you visit our website, the following data are temporarily stored in a log file, the so-called server log files:

  • IP address of the requesting computer
  • date and time of access/request
  • name and URL of data requested
  • operating system of your computer and the browser used by you
  • access status/HTTP status code
  • volume of data transferred in each case
  • last website visited
  • browser settings

The legal basis for the temporary storage of the personal data and the log files is our legitimate interest. This legitimate interest exists to

  • properly deliver the content of our website
  • optimise the content of our website
  • provide criminal prosecution authorities with the necessary information for criminal prosecutions in the event of a cyber attack
  • further enhance our offerings and our website
  • collect statistical data

This data is not stored along with other personal data pertaining to you. The data will be erased as soon as they are no longer necessary to achieve the purpose for which they were collected.

2.2 Erasure

We process and store your personal data only for the period required to achieve the purpose for such storage or as required by the laws or regulations that we are subject to. If the purpose for such storage of the required retention period no longer applies, the personal data will be routinely blocked or erased in accordance with applicable law.

In addition, we erase your personal data if you request us to do so at info@ems-group.com and we have no retention obligation or other obligation to secure such data.

2.3 Newsletter

You have the option to subscribe to our newsletter via our website.

If you wish to subscribe to our newsletter, the following information (*mandatory) is required. The additional information is voluntary:

  • Form of address
  • First name*
  • Last name*
  • Email address*
  • Address
  • Postcode
  • Town/city
  • Subject
  • Language
  • Password*

Completion of the fields designated as mandatory is required to send you the newsletter. Voluntarily providing us with additional data enables us to provide you with targeted information.

The personal data transmitted by you will not be merged with other data.

The legal basis for processing your personal data after registering for the newsletter is the receipt of your consent. In order to process your data, your consent is therefore requested during the registration process and reference is made to this Privacy Statement. By consenting, you agree that we may use this data for the purpose of sending the newsletter in order to inform you of EMS Group news.

In addition, the following data are also collected at registration:

  • IP address of the requesting computer
  • date and time of registration

We process this data based on our legitimate interest. We need this data to send you the newsletter.

We use the so-called double opt-in process for registering for our newsletter. This means that after you provide your email address, we send a confirmation email to the email address provided, requesting you to confirm that you wish to receive the newsletter. The confirmation is made by clicking on an activation link in the confirmation email. Following receipt of the confirmation we will email you our newsletter.

You have the option at any time to cancel your subscription to the newsletter and to revoke the consent your provided. To do this, click on the corresponding field in the newsletter sent to you or on our website. You can also send your revocation to the following email address: infoems-group.com.

We will store your personal data until such time as you cancel your subscription to the newsletter.

2.4 Ordering brochures and direct email contact

You can order brochures on our website or contact us by writing an email to our published email addresses. If you wish to order brochures, the following information (*mandatory) is required. The additional information is voluntary:

The personal data transmitted by you via forms or emails will not be merged with other data and will be deleted after completion of your request.

2.5 Completion of a contact form

There are various places on the website where you can make an appointment with us.

The legal basis for the processing is our legitimate interest in providing this service. If the processing is for the purpose of performing a contract to which you are a party or for the purpose of executing pre-contractual measures, this serves as an additional legal basis for the processing of your personal data.

Your personal data will be erased as soon as they are no longer necessary to achieve the purpose for which they were collected. For the personal data from the input screen and those transmitted by email, this is the case when the relevant conversation with you has terminated. The conversation is terminated when it is evident from the circumstances that the applicable issues have been fully resolved.

2.6 Marketing

We may also use the personal data transmitted by you on the basis of our legitimate interest for the following purposes:

  • to communicate about certain products or marketing initiatives and
  • to recommend products or services to you that might be of interest to you

2.7 Online applications

If you apply for a job with us, we will process your information in order to process your application. During the application process, your form of address, last name, first name, date of birth, nationality, as well as the usual correspondence details such as postal address, email address and telephone numbers, will be stored in the applicant database. In addition, all documents submitted by you in connection with the application will also be retained. These data are stored, analysed, processed or forwarded internally only in connection with your application. The personal data may be processed for statistical purposes (e.g., reporting). In this case, it is not possible to identify individual persons.

The processing may also occur electronically. This is the case, in particular, if you send us corresponding application documents electronically, for instance by email.

The legal basis for the processing is our legitimate interest in processing of your application.

If we conclude an employment contract with you, the transmitted data will be stored for the purpose of implementing the employment relationship subject to applicable law. If the application process ends without employment, your personal data will be stored for a further three months for documentation purposes and then erased unless you have given us your consent to use your information for future application processes with us.

Notwithstanding the above, you have the option at any time to have your electronic data erased. You may send your request for erasure to the person named as the contact person in the job posting or to infoems-group.com.

2.8 Cookies

We place so-called cookies on our website based on our legitimate interest. These are small text files that are saved to your end device with the help of the browser. When you visit a website, a cookie may be stored on your operating system. This cookie contains a characteristic character string which enables the browser to be clearly identified the next time the website is visited.

A cookie enables us to optimise information and offerings on our website specifically for you. Cookies allow us to recognise visitors again. The purpose of recognising you again is to make it easier for you to use our website.

We use session cookies. These are automatically deleted when you close the browser. They store a so-called session ID which allows different requests from your browser to be assigned to the joint session. This allows your computer to be recognised again, when you return to the website. We use this type of cookie to ensure the operation and functionality of our website.

2.9 Web analysis tools

2.9.1 Google Analytics

Based on our legitimate interest we use Google Analytics, a web analysis service of Google Inc. ("Google"), 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA. Google uses cookies.

We use Google Analytics including all functions with the latest technology and version offered by Google. Google Analytics allows us to analyse the activities on our web pages across different devices (e.g., in the case of access through a laptop and later through a tablet). This means that data, sessions, localizations and interactions across a number of different devices can be assigned a pseudonymized user ID, thus enabling the analysis of a user's activities on a range of devices.

The information generated by the cookie regarding your use of this website (including your IP address) will be transferred to one of Google's servers in the USA and stored there. Google has joined the Data Privacy Framework and thereby warrants that it complies with European data protection law (https://www.dataprivacyframework.gov/s/participant-search/participant-detail?id=a2zt000000001L5AAI&status=Active).

Google uses this information on our behalf in order to analyse your use of our website, to compile reports on the website activities and to provide us with additional services related to the use of the website and the internet.

We use Google Analytics only with activated IP anonymization. This means that the IP address of the user is abbreviated by Google within the member states of the European Union or in other countries that are signatories to the Agreement on the European Economic Area. Only in exceptional cases will the full IP address be transferred to one of Google's servers in the USA and abbreviated there.

2.9.2 Google-Ads

Based on our legitimate interest (i.e., our interest in analysis) we use the advertising program "Google Ads" which is part of Google's online marketing services.

This process involves Google Ads placing a cookie on your computer ("conversion cookie") when you have accessed our website via a Google advert. If you visit certain of our web pages and the cookie has not yet expired, we and Google can recognise that someone has clicked on the advert and was directed to our web page as a result. The information obtained using the conversion cookie is used to prepare conversion statistics for Ads customers who have decided on conversion tracking. We receive no information through which you can be personally identified.

Based on the information collected, categories that relate to your interests are assigned to your browser. These categories are used to place advertising that relates to your interests.

The data acquired about you with the aforementioned cookie (so-called conversion tracking) is used by us for the following purposes:

  • target groups with shared interests
  • user-defined target groups with shared interests
  • similar target groups
  • demographic and geographic alignment.

2.10 Social Plugins

We use plugins on our website. Plugins are small programmes or programme packages which are used to adapt and expand software in accordance with one's requirements. Many programmes, such as graphics programmes, media players or internet browsers, support the functions used by a normal user in their basic version.

We have incorporated links on our website to our social media profiles on the following social networks:

When you click on a link to one of our social media profiles, a direct connection is established between your browser and the server of the applicable social network. Thereby the network receives the information that you visited our website with your IP address and clicked on the link. If you click on a link to a network while you are logged into the relevant network in your account, the content of our site may be linked with your profile in the network, which means that the network can assign your visit to our website directly to your user account and as a result we receive your personal data such as your name, email, location, friends list and profile picture. This data enables us to offer certain features on the sites. If you wish to prevent this from happening, you should log out before activating corresponding links. Your visit will be assigned in any case when you log in to the relevant network after activating the link.

If you are logged in to a social network through your user account while visiting our website, the relevant provider can also assign the site visit to your user account. If you interact with a plugin, the corresponding information is also being transmitted directly to a server of the relevant provider in the USA and stored there. The information is also published through your user account in the relevant social network and displayed to your contacts there.

Even if you are not logged on with the providers of the plugins during your visit to our website, the data collected by the plug-ins may in some circumstances be assigned to your relevant user account. A plug-in allows the placement of a cookie with an ID each time the website is visited. Since your browser sends this cookie unsolicited whenever there is a connection with a server of the relevant provider, the social networks could, in principle, create a profile showing which website the user linked to the ID has visited. It would then be possible, as the case may be, to again assign this ID to a person at a later point, for example upon subsequently logging on with the provider.

With this setting, however, aside from the plug-ins, other cross-site features of other providers may also stop functioning.

2.11 Use of the website by minors

The website is intended for adults. With the exception of our offers in the area of vocational education, minors, especially children under the age of 16, are prohibited from transmitting personal data about themselves to us or from registering for a service. If we notice that such data has been sent to us, they will be erased from our database. The child's parents (or legal representative) may contact us and request the erasure or deregistration. In order to do so, we need a copy of an official document showing that you are the parent or legal guardian.

2.12 Links to websites of other providers

Our websites may contain links to other providers' websites, which are not covered by this Privacy Statement. After clicking on the link, we no longer have any influence on the processing of any data that is transferred to the third party by clicking on the link (such as, for example, the IP address or the URL at which the link is located), as the behaviour of such third party is by definition beyond our control. We do not take responsibility for the processing of your personal data by third parties. To the extent that the use of other providers' websites involves the collection, processing or use of personal data, please take notice of the privacy policies of the respective providers.

3. Customers, suppliers and other business partners

For the purpose of performing our contractual obligations, EMS processes master data (e.g., names and addresses as well as contact details) and the contract data (e.g., services used, names of contact persons, payment information) of customers, suppliers and other business partners in order to provide optimum performance of our contractual obligations and services.

The legal basis for processing corresponding personal data is performance of a contract, execution of pre-contractual measures or our legitimate interest.

If we store the data based on a contractual relationship, these data remain stored for at least as long as the contractual relationship exists and until at the latest the end of the statute of limitation periods for any potential claims by us or the end of any statutory or contractual retention obligations.

4. Disclosure to third parties

We only disclose your personal data if we have obtained your express consent thereto, we are obligated by law to do so, or this is necessary in the context of using the website or in order to perform or initiate a contract.

We may disclose your personal data to the following categories of recipients:

  • Authorities

The disclosed data may only be used by the third parties in the context of the limited purpose applicable in each case. Third parties are obligated to protect your privacy to the same extent as we ourselves are. Further, they are obligated to process your personal data in accordance with our instructions and in compliance with the EU data protection standard. If the data protection standard in a country is not viewed as equivalent to Swiss standards, respectively at the level of the GDPR, we ensure through contractual obligations that your personal data is protected at all times in accordance with Swiss guidelines, respectively the GDPR.

Insofar as we use subcontractors to provide our services, we take appropriate legal measures as well as corresponding technical and organisational steps to ensure that your personal data is protected pursuant to the applicable legal requirements.

5. Rights of data subjects

With regard to your personal data, you generally have the rights to information, rectification, erasure, restriction, data portability, objection and revocation. If you believe that the processing of your personal data violates privacy laws or that your privacy rights have been otherwise infringed, you may complain to the supervisory authority. In Switzerland this is the Federal Data Protection and Information Commissioner (FPIC).

6. Data security

We take technical and organisational security measures to protect your personal data from interference, loss or destruction or from access by unauthorised persons and to ensure the protection of your rights and compliance with the applicable data protection provisions.

The aim of the measures is to permanently ensure the confidentiality and integrity of your personal data as well as the availability and resilience of our systems and services when processing your personal data. They also aim to ensure that, in the event of a physical or technical incident, the availability of the data and access thereto can be quickly restored.

We continuously improve our data processing and our security measures in line with technological progress.

If you register with us as a newsletter user, access to your user account will only be possible upon entering your personal password. Access credentials should always be treated as confidential and the browser window closed after you have ended your communication with us, especially if you use the computer alongside other users.

We also take our own internal data protection within the company very seriously. Our staff and the service providers with whom we contract are obligated to uphold confidentiality and to comply with the requirements of data protection law. Furthermore, they are only granted access to personal data to the extent necessary.
